The controlling document should be the Swiss birth certificate which Edith presented to Mrs. Drewe, and whatever name appears on it. Any subsequent action would have been done in ignorance of the controlling document, so once this is discovered, the name on that document should prevail. (Caveat - IANAL)
That doesn't apply here; if Edith reveals that, it admit Marigold is a bastard and shames her family... so it's irrelevant until the 70s when illegitimacy becomes allowed for women.
Thus, it'd be the name the Drewe's baptised her with.
There are still too many plot holes on that story. Have the Drewes even filed anything at this point? How did they get past the absence of a birth cirtificate? Probably not too difficult at that time, because it was still the very end of an era in which children were often born in the home.
Since it appears that only Edith and the Drewes even know of the existance of the birth certificate, they can continue with whatevere name she currently goes under, however once the actual birth certificate becomes known, it will supercede any filings made in ignoramce.
Well when Mrs Drewe tore up the copy of the birth certificate that Edith presented as proof of her being Marigold's mother Edith said she has other copies. We don't know where she is keeping them hidden from prying eyes, though perhaps one safe bet would be a bank safe deposit box.
Most likely it seems when Marigold was born she was born with her mother's surname since she and Michael weren't married, but the Drewe's mentioned having her Christened so for that time she had their last name. I would say Edith probably would have it change back to make it look like her "adoption" of the orphan is official, and maybe Cora would want that too. And HPR has a point that Marigold could never bear her father's surname unless by some miracle he comes back from the dead a free man and can marry Edith. No doubt he would have her name changed whether or not she was revealed to be his and Edith's child.
To use another example, Ethel's illegitimate son has her last name and not his father's last time we saw him. However I imagine when she handed over custody of him to his grandparents they would change the surname to hide his illegitimacy (they mentioned beforehand proposing hiding his origins to make people think his parents were married in the war and his mom died from Spanish flu). I know the circumstances are different and I'm just speculating here, but my guess is Crawley is her true surname.

The part about him possibly coming back was my point, not HPR's. Sorry if that was confusing. But yes, without him Marigold cannot bear his surname.
Yeah, Ehj666: While the birth certificate isn't know about, Marigold's surname is whatever the Drewe's gave her. When it is, it will become Crawley.
If she is now a ward of the family, (which is what I imagine the Crawleys will tell everyone), she'd likely take their surname, so I think 'Crawley' is the likeliest option.

Certainly I would think so too, that way the cover story of Edith "adopting" her for the Drewes' sake would seem official and therefore more credible; no one would be likely to question it any further.
I also noticed on Wikipedia she is referred to as Marigold Crawley, but of course that can always be changed too.
I'd say that her legal surname is the one on her birth certificate, which presumably lists her as Marigold Crawley, since Edith used her real name. However, I'd say that you're right that the name she uses is whatever surname she was baptised under when the Drewes took her in.
Yeah; legally, it's Crawley... but due to being illegitimate, she cannot use it, so it is whatever the Drewe's gave her.
